Purpose of the processing

The processing is carried out in order to:

  1. to allow you to use the content on the www.nottoopet.com website (hereinafter, the “Site”);
  2. to correctly and completely execute the “Registration” and “Customer Service” services that you may request and available on the Site. For the description of the services, see the “Terms of Use“;
  3. to correctly and completely execute any sales contract you have concluded online with PET CONCEPT ITALIA or to execute pre-contractual measures adopted at your request;
  4. subject to your consent, send you the commercial communications of PET CONCEPT ITALIA (“Newsletter”) by email. You may at any time revoke your consent or object to the receipt of such communications (by means of the appropriate link at the bottom of each email or by contacting the Data Controller);
  5. to manage and respond correctly and completely to any communications or requests sent to PET CONCEPT ITALIA using the contact details on the Website (“Contacts”);
  6. for the fulfilment of legal obligations.

Categories of personal data processed

Your personal data that are processed are:

  • “Contacts”, in particular: your e-mail address and any additional personal data that you may contain in your message or necessary for the correct and complete management of your request;
  • “Registration”, in particular: your name and surname, email address, username and password, date of birth, tax code, residence/shipping address, payment data, telephone number, data relating to your purchases;
  • for the conclusion and execution of the sales contract you have concluded online with PET CONCEPT ITALIA or to execute pre-contractual measures adopted at your request, in particular: your name and surname, tax code, residential/shipping address, email address, telephone number, data relating to your purchase, payment data;
  • “Customer Service”: your name and surname, telephone number, email address and any other data necessary to satisfy and respond to your request for information and assistance relating to online sales (in particular, data relating to your purchases);
  • “Newsletter”: your e-mail address;
  • in the event of your communications or requests sent to PET CONCEPT ITALIA using the contact details on the Website, in particular: the personal data you used for your communication (postal address, telephone number, fax number or e-mail address), as well as any additional personal data that you may contain in your message or necessary for the complete and correct management of your communication or request;
  • for the fulfilment of legal obligations: the personal data necessary to carry out the obligations required by law.

Processing methods

Personal data may be processed by means of both paper and computer archives (including portable devices) and processed in ways that are strictly necessary to meet the purposes indicated above.

Legal basis of the processing

Your personal data are processed:

  • to conclude a contract and follow up on your requests (use of the contents of the Site, “Contacts”, “Registration”, “Customer Service” services, as well as management and response to any communications sent to PET CONCEPT ITALIA using the contact details on the Site);
  • subject to your express consent, to send you the “Newsletter”;
  • to correctly and completely execute any sales contract you have concluded online with PET CONCEPT ITALIA or to execute pre-contractual measures adopted at your request;
  • to comply with legal obligations.

Consequences of not providing personal data

Failure to provide data may make it impossible, depending on the case, to use the contents of the Site, the services available on the Site (“Contacts”, “Registration”, “Customer Service” and “Newsletter”), to receive responses to any communications or requests, to be able to conclude and execute the online sales contract with PET CONCEPT ITALIA or to execute pre-contractual measures requested by you, to be able to receive commercial communications from PET CONCEPT ITALIA (“Newsletter”).

The provision of your personal data for the services available on the Site (“Contacts”, “Registration”, “Customer Service” and “Newsletter”) is completely optional. The provision of your personal data in order to conclude and execute the online sales contract is mandatory in order to conclude and execute the contract or as required by law.

Data retention

Your personal data, subject to processing for the purposes indicated above, will be stored:

  1. a) for the “Contacts” and “Customer Service” services, as well as for the management and response to any communications or requests sent to the addresses on the Site, for 6 (six) months from the complete and correct management of your communication and/or request;
  2. b) for the “Newsletter” service, until the termination of the service by PET CONCEPT ITALIA or until you revoke your consent to receive the “Newsletters” that you can express at any time by using the appropriate link at the bottom of each newsletter or by contacting PET CONCEPT ITALIA and, in any case, for a maximum period of 1 (one) year from the time you gave your consent. Your personal data will no longer be subject to such processing even if you decide to object to the processing of your personal data for direct marketing purposes (regarding the “right to object” see the following paragraph “Rights of the data subject”);
  3. c) for the “Registration” service, until the termination of the service by PET CONCEPT ITALIA or until the cancellation of your account, which you may decide at any time to carry out using the appropriate function in your reserved area (“Cancel Account” function) or request by contacting PET CONCEPT ITALIA at the addresses indicated on the Website and in this information (“Data Controller” and “Contacts” paragraphs);
  4. d) for the conclusion and execution of the online sales contract or for the execution of pre-contractual measures adopted at your request, for 10 (ten) years from the correct and complete execution of the sales contract concluded by you online with PET CONCEPT ITALIA or from the correct and complete execution of the pre-contractual measure requested by you;
  5. e) for the fulfilment of legal obligations, for the duration provided for by law.

For technical reasons, the termination of the processing and the consequent deletion of your personal data will take place within 30 (thirty) days of the terms indicated above.

This is without prejudice to cases in which retention for a subsequent period is required for any litigation, requests from the competent authorities or pursuant to applicable legislation.

Communication of data

Your personal data may be communicated:

  1. a) to personnel or collaborators specifically authorized by the Data Controller (internal staff or collaborators);
  2. b) to third parties used by the Data Controller to provide services (so-called Data Processors), such as IT service providers, Internet and telecommunications operators;

  4. d) possibly to the police forces and to the judicial and administrative authorities, in accordance with the law.

Transfer of data outside the European Union (EU) or the European Economic Area (EEA)

Your personal data will not be transferred to entities located in countries outside the European Union (EU) or outside the European Economic Area (EEA) that do not offer an adequate level of data protection (https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection/adequacy-decisions_en).

Rights of the data subject

You have the right to:

  1. a) access to your personal data, i.e. to have confirmation as to whether or not personal data concerning you is being processed and, if so, to obtain access to the personal data and information about their processing;
  2. b) rectification of your personal data, i.e. to obtain the correction, modification or updating of any inaccurate or no longer correct information, as well as to obtain the integration of incomplete personal data, also by providing a supplementary statement;
  3. c) deletion of your personal data. The right to erasure cannot be exercised in the event that your personal data must be processed for the fulfilment of a legal obligation to which the Data Controller is subject, as well as for the establishment, exercise or defence of a right in court;
  4. d) limitation of the processing of your personal data, i.e. to obtain from the Data Controller the right to store such data without being able to use them. That right can be exercised only where (i) You contest the accuracy of the personal data, for the period necessary for the Data Controller to verify the accuracy of such personal data, or (ii) the processing of your personal data is unlawful and you request the restriction of its use, rather than erasure, or (iii) although the Data Controller no longer needs them for the purposes of the processing, your personal data are necessary for the establishment, exercise or defence of legal claims, or (iv) when you object to the processing (see “right to object”), during the period in which the Data Controller assesses the reasons for your request;
  5. e) data portability , i.e. to obtain your personal data from the Data Controller in a standard format, as well as transferred, where technically possible, directly to a third party indicated by you;
  6. f) revokeyour consent to the processing of your personal data.
